Terms of Use

Welcome to pTarot (“we,” “us,” or “our”). These Terms of Use (the “Terms”) are a legal agreement between you and pTarot that govern your use of our platform and any associated mobile applications or services that display these Terms (collectively, the “Platform”).

By accessing or using our Platform, you signify that you have read, understand, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use our Platform.

We may revise these Terms from time to time at our sole discretion. When we do, we will post or otherwise make available the updated Terms and indicate the date they were last modified. Your continued use of the Platform after such updates are posted will constitute your acceptance of the changes.

1. Platform Description and Purpose

Our Platform provides tarot and other esoteric services, including (but not limited to) online tarot readings, the ability to ask questions to tarot readers, access to card meanings, and other related or ancillary offerings. These services are for entertainment purposes only and are not meant to replace professional advice of any kind.

2. Arbitration Notice

Unless you opt out within 30 days of first agreeing to these Terms, you agree that most disputes between you and pTarot will be resolved by confidential, binding arbitration on an individual basis, and you waive your right to a trial by jury or to participate in a class action, as further detailed in the Arbitration Agreement and Class Action Waiver section below.

3. Creating an Account

Eligibility: You must be at least 16 years old to create an account on our Platform.
Account Information: When creating an account, you agree to provide accurate and current information about yourself (such as your name and email address).
Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.
Account Termination: We reserve the right to close or suspend your account at our discretion, for any or no reason.

4. Use of Coins (Virtual Currency)

Coins: Our Platform uses virtual coins (“Coins”) as the currency for certain offerings (e.g., tarot readings, esoteric sessions). You can obtain Coins in two ways:
- Purchase: You may purchase Coins in packages for real-world currency (e.g., using a credit card or other approved payment method).
- Promotions/Bonuses: We may, at our sole discretion, grant Coins for free (e.g., during promotions or upon registration).
Non-Transferable: Coins cannot be transferred to other users, exchanged for other forms of virtual currency, or redeemed for cash unless required by law.
Usage: Whenever you pay for a service (e.g., a tarot reading), the required number of Coins will be deducted from your account.
No Refunds: Unless otherwise required by law, your purchase of Coins is final and non-refundable once purchased. Please see Section 9. Payment, Refund & Expiration Policy for additional details.
Escheat Laws: Unused Coins may be subject to applicable state laws regarding unclaimed property.

5. Intellectual Property

Ownership: All content included on the Platform—such as text, graphics, designs, logos, icons, presentations, videos, data, articles, software, and other materials (collectively, the “Materials”)—is owned by or licensed to pTarot. The Materials are protected by copyright, trademark, and other intellectual property laws.
Trademarks: pTarot and any associated logos, service marks, or other identifying marks that appear on the Platform are our property. Trademarks of third parties appearing on the Platform are the property of their respective owners.
Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Platform and Materials for your personal, non-commercial use. No other license or right is granted, either expressly or by implication.

6. Platform Restrictions

You agree that you will not (and will not permit anyone else to):

Use any data mining, robots, or similar data-gathering methods to scrape or download content from the Platform.
Copy, distribute, modify, sell, or otherwise exploit any Materials for commercial or personal gain unless expressly permitted.
Mirror or frame the Platform or any part of it.
Circumvent or disable any security features of the Platform, decompile or reverse-engineer any part of the Platform.
Interfere with or disrupt the Platform or its servers.
Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
Collect, track, or store information about other users without their consent.
Use the Platform for any illegal or unauthorized purpose, or violate any laws in your jurisdiction.
Post or upload content that is obscene, harassing, discriminatory, or otherwise objectionable.

7. User Content

User Submissions: You may be able to submit content on or through the Platform (e.g., comments, reviews, photos, text). By posting content, you grant pTarot a non-exclusive, perpetual, worldwide, royalty-free, transferable license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such content in any media.
Responsibility: You are solely responsible for the content you submit, and you represent and warrant that your content does not violate the rights of any third party.
No Prescreening: We do not prescreen user content, but we may remove any content that, in our judgment, violates these Terms or applicable laws.

8. Termination

We reserve the right, in our sole discretion, to:

Terminate your account for any or no reason, without notice.
Restrict or block your access to all or any part of the Platform.
Remove or delete any of your user content.

9. Payment, Refund & Expiration Policy

Payment: When you purchase Coins or other products, you authorize pTarot (or our designated payment processor) to charge the payment method you have provided.
Refund Policy:
- Coin Purchases: Unless otherwise stated, all purchases of Coins are final and non-refundable.
- Mandatory Refund Rights: If your jurisdiction provides you with a cooling-off period or other statutory rights (e.g., in the UK or EU), we will honor those requirements as applicable.
Expiration: Unused Coins may expire if required by applicable law or stated in your account or relevant documentation.
Account Termination: If your account is terminated (by you or by us), any remaining Coins in your account may be forfeited, unless otherwise required by law.

10. Representations and Warranties

By using the Platform, you represent and warrant that:

You are at least 16 years of age.
You have provided accurate and current information where requested.
You are eligible to use the Platform and have the right and authority to agree to these Terms.
Your use of the Platform does not violate any applicable law or regulation.
You will not use the Platform for any fraudulent activities.

11. Disclaimer of Warranties

The Platform (including all tarot readings, esoteric services, and any Materials) is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied.
Entertainment Only: Tarot readings and other esoteric services are for entertainment purposes only and should not be regarded as professional advice (financial, medical, legal, or otherwise).
We do not guarantee that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law:

pTarot, including its affiliates, officers, directors, employees, and agents, will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of (or inability to use) the Platform.
Our total liability for any claim arising out of or relating to these Terms will not exceed the total amount paid by you to pTarot for products and services in the three (3) months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless pTarot and its affiliates, licensors, and service providers (and their officers, directors, employees, and agents) from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Platform,
Your breach of these Terms,
Your violation of any applicable law or rights of a third party.

14. Communications

By using the Platform, you consent to receive certain electronic communications from us. You can opt out of:

Email Marketing: By clicking “Unsubscribe” in any marketing email.
Telegram: By clicking “Unsubscribe” in bot menu (if it was connected).

15. Third Party Services

The Platform may contain links to websites or services operated by third parties (“Third Party Services”). We do not control or endorse such Third Party Services, and we are not responsible for their content or policies. Your dealings with such Third Party Services are solely between you and the third party.

16. Arbitration Agreement and Class Action Waiver

Mandatory Arbitration: Except as noted below, all disputes arising out of or related to these Terms or your relationship with pTarot will be resolved by confidential, binding arbitration instead of in court. You are waiving your right to a trial by jury.
Class Action Waiver: You agree that any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted.
Opt-Out: You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by contacting us at [email protected]. If you do so, you may pursue your claim in court.
Exceptions: You and pTarot may still bring individual claims in small-claims court, and either party may seek equitable relief for intellectual property infringement in a court of competent jurisdiction.

17. Miscellaneous

Survival: Any provisions of these Terms that by their nature should survive termination will survive, including (but not limited to) Intellectual Property, Disclaimers, Limitations of Liability, Indemnification, and Arbitration provisions.
Assignment: These Terms are personal to you. You may not assign them without our prior written consent. We may assign these Terms without restriction.
Governing Law: These Terms and any disputes will be governed by the laws of Ukraine, without regard to conflict-of-law principles..
Limitations on Claims: Any claim or cause of action you have arising from or related to use of the Platform must be filed within one (1) year after the claim arises; otherwise, it is permanently barred.
No Waiver: Our failure to exercise any right under these Terms will not constitute a waiver of that or any other right.
Severability: If any provision of these Terms is deemed unlawful or unenforceable, that provision will be severed from the Terms and the remaining provisions will remain valid and enforceable.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Platform and supersede all prior or contemporaneous agreements or understandings.
